§1. OBJECT OF THE REGULATIONS
  1. The regulations define the rules for the provision of services, liabilities, and stay at the training and recreational center “Góra Spokoju. Osada Klimatyczna-Leśna” (Tranquility Hill. Forest Retreat), hereinafter referred to as “Tranquility Hill”, located at plot no. 840, ul. J. Tuwima 41, Inowłódz (97-215), Poland, and are an integral part of the agreement, which is concluded by sending an email confirmation of the reservation, completing the Check-in card, making a deposit payment or full payment for the stay at Tranquility Hill. By making a reservation or staying at Tranquility Hill, the Guest accepts the conditions of the Regulations.
  2. The regulations apply to all persons staying at Tranquility Hill.
  3. The regulations are available for viewing on the website www.goraspokoju.pl/regulamin and at the registered office of OneTable Sp. z o.o., ul. J. Tuwima 41, 97-215 Inowłódz, Poland (also referred to as “the Lessor”).
  4. This regulation is subject to Polish law and has been prepared in the Polish language with translations into English and German.
§2. HOTEL DAY 
  1. In the case of residential rentals, the hotel day lasts from 15:00 on the day of rental until 11:00 the next day. The length of the hotel day stated above may be subject to changes depending on the arrangements made by the Lessor and the Guest during the reservation and specified in the reservation confirmation.
  2. In the case of organizing special events, each event room or outdoor space is rented for a specified period as indicated in the reservation/order form.
  3. The minimum length of stay for residential purposes is two days.
  4. If the Guest wishes to extend their stay beyond the period indicated in the reservation, they should inform the Lessor by 9:00 am on the day the rental term expires, either via email or by phone. The request does not bind the Lessor. The Lessor will consider the request for an extended stay based on the availability of accommodation.
  5. If the reservation was made through an intermediary, the Guest should communicate their request for an extension or shortening of the stay beyond the period indicated in the reservation to the relevant entity or third party through whom the reservation was made.
  6. Staying on the premises of Tranquility Hill or leaving belongings in the rented house or room after 11:00 am (for residential rentals) or 1 hour beyond the specified time in the reservation form (for all other cases) will be treated as an extension of the stay.
  7. The Lessor reserves the right to refuse an extension of the Guest’s stay in the event of the Guest’s non-compliance with the regulations or in case of unavailability of houses/rooms or failure to make full payment for the previous stay in advance.
§3. RESERVATION AND CHECK-IN
  1. All houses and rooms located in Tranquility Hill have electronic locks that are opened using access codes. The access code to the rented house or room is provided on the day of the stay or after the Guest has submitted the check-in card. On the day of arrival, the Guest will also receive a mobile phone number for opening the entrance gate to Tranquility Hill.
  2. Only registered guests are allowed to stay in Tranquility Hill.
  3. Guests renting for residential purposes are required to present an identification document with a photo upon check-in. In case of refusal to present the document in a manner that enables check-in, the Lessor may refuse to rent the house or room.
  4. The Lessor may refuse to rent a house or room in Tranquility Hill to guests under the influence of alcohol or other intoxicating substances.
  5. The check-in card should primarily include the guest’s full name, registered address, PESEL number, series and number of the identification document, as well as contact details (phone number and email address). By sending the check-in card to the Lessor via email, the Guest confirms the accuracy of the provided information.
  6. Making a reservation, payment, and starting the stay in Tranquility Hill are equivalent to the Guest’s acceptance of the provisions of the Regulations.
  7. Non-registered individuals may stay in Tranquility Hill between 7:00 am and 11:00 pm. Staying of non-registered individuals in a house or room after 11:00 pm implies the Guest’s consent to pay for accommodating these individuals in the rented house or room. Each additional person will be charged according to the current price for an extra adult, as stated in the price list attached to these Regulations.
  8. The Lessor may refuse to accommodate a Guest who has significantly violated the Regulations during a previous stay, particularly by causing damage to the Lessor’s or other guests’ property, causing harm to another guest’s person, the Lessor’s employees, or other individuals present in Tranquility Hill. Furthermore, the Lessor may refuse to accommodate a Guest who, in the judgment of the staff, poses a threat to the safety, health, reputation of other guests, employees, or Tranquility Hill (the brand).
  9. The Lessor reserves the right to preauthorize a credit or debit card or collect a cash deposit of PLN 300 upon check-in.
  10. The Lessor reserves the right to verify the availability of funds on the credit card provided for the reservation before the planned arrival date.
  11. The collected cash deposit will be returned, and the preauthorization on the Guest’s card will be released upon check-out, after settling the bill and inspecting the condition of the house or room by the Lessor’s staff.
  12. In the event of failure to cancel the reservation within the specified period stated in the reservation terms or if the Guest does not arrive at Tranquility Hill on the planned date, the Lessor will charge the Guest for the first hotel day, with the exception that if the Guest made a reservation without the possibility of free cancellation, the Lessor will charge the Guest for the entire reserved stay.
  13. In the event of the Guest’s resignation from the stay during the hotel day, the Lessor does not refund the fee for that hotel day.
  14. The Guest is entitled to change the reservation dates in Tranquility Hill no later than 48 hours before the start of the hotel day on the day of arrival, provided that the Lessor has available dates and houses or rooms.
  15. Reservations can be made by email or by phone:
  • Reservation via email can be made by sending a message to the email address kontakt@goraspokoju.pl or using the form available on the website www.goraspokoju.pl. After checking the availability of vacant houses or rooms by the Landlord, the Guest will be informed via email or phone about the possibility of making a reservation. A response to the sent message will result in the reservation being entered into the database.
  • Telephone reservations can be made by calling the Lessor’s office at +48 604 900 071. After checking the availability of houses or rooms by the Lessor, the Guest will be informed about the possibility of reservation. The confirmation of the reservation will be sent to the Guest via email or, in the case of “last minute” offers, through an SMS message or verbally over the phone. The sent message or conveyed information will result in the reservation being entered into the database.
§4. WITHDRAWAL FROM THE AGREEMENT
  1. In exceptional situations, such as a malfunction in the rented house or room, the Lessor reserves the right to exchange the rented house or room for an equivalent one at the same or lower price.
  2. In the event of force majeure, the Lessor is entitled to withdraw from the rental agreement. This right applies when, without the Lessor’s fault, they will be unable to ensure the safety of the Guests or their property.
  3. In the event of withdrawal from the rental agreement in the situations mentioned in paragraph 2 above, the amount already paid by the Guest will be promptly refunded, with the Lessor being entitled to deduct the amount due for the stay already utilized.
§5. PAYMENT 
  1. Payment for the stay can be made by: a) Cash at the Lessor’s office on the day of arrival, upon receiving the access codes to the house or room. b) Bank transfer to the Lessor’s bank account no later than 24 hours before the start of the hotel day on the day of arrival. If the payment is not credited to the Lessor’s bank account before the start of the stay, the Guest is required to send proof of payment via email. c) Credit card or debit card.
  2. For long-term stays, reservations made at least 10 days in advance, or reservations for more than one house or room, the Lessor requires a deposit of 30% of the reservation value. The deposit must be paid within 3 days from the date of making the reservation.
  3. Upon request of the Guests, the Lessor issues VAT invoices. The Guest is obligated to inform the Lessor of the need for an invoice when making the reservation.
§6. GUEST RESPONSIBILITIES 
  1. The Guest is fully liable for any damages or destruction of the equipment and technical devices located within the Tranquility Hill premises, resulting from their actions, omissions, or the actions or omissions of their registered or visiting persons. The Guest is also financially responsible for significant stains. The current price list for additional cleaning of unusual stains is available at the Lessor’s office.
  2. Quiet hours are in effect within the Tranquility Hill premises from 11:00 PM to 7:00 AM the following day. During quiet hours, Guests and all individuals present within the Tranquility Hill premises must adhere to silence and refrain from disturbing the peace of other individuals by creating excessive noise or any other means.
  3. Children under the age of 13 who are present within the Tranquility Hill premises must be under the constant supervision of their legal guardians. Legal guardians are responsible for the safety of the children under their care and bear the material responsibility for any damages caused by the children under their care.
  4. The Lessor reserves the right to charge the Guest’s credit or debit card for any damages discovered after their departure or in the event of non-payment by the Guest for accommodation or other services.
  5. The Lessor has a statutory right of lien on items brought onto the Tranquility Hill premises by the Guest in the event of delayed payment for the stay or non-payment for the services provided.
  6. In the event of a breach of the provisions of the Regulations, the Lessor may refuse to provide services to the person who violates them. Such person is obliged to promptly comply with the Lessor’s requests, settle any outstanding payments for services rendered, pay for any damages if applicable, and vacate the Tranquility Hill premises.
  7. Each time the Guest leaves the house or room, they are obliged to turn off the TV, air conditioning, lights, close the taps, windows, and the front door to prevent unauthorized access to the respective house or room.
  8. Parties or any disturbance of the quiet hours are strictly prohibited in the houses or rooms. For organizing a party in a house or room or any violation of the quiet hours, the Guest will be fined an amount of PLN 500. Parties may only be held in designated event halls or spaces designated by the Lessor. Guests wishing to organize a party within the Tranquility Hill premises must notify the Lessor at the time of making the reservation.
  9. For fire safety reasons, the use of heaters, irons, and other electrical devices that are not part of the house or room’s equipment is prohibited. The above does not apply to chargers and power supplies for audiovisual and computer devices. The use of open flames in any form is also prohibited.
  10. Smoking cigarettes and tobacco products is strictly prohibited in the houses, rooms, or any other premises within the Tranquility Hill premises, in accordance with the Act of 8 April 2010 amending the Act on the protection of health against the consequences of tobacco use and tobacco products, and the Act on the State Sanitary Inspection (Journal of Laws No. 81, item 529). This prohibition also applies to the use of any other substances, including medicinal ones, that require heating or burning.
  11. Storing hazardous materials, including weapons, ammunition, flammable, explosive, and illuminating materials, is prohibited on the Tranquility Hill premises.
  12. In the event of a violation of the prohibitions, the Guest will be fined an amount of PLN 1000. If the Guest’s violation of the prohibitions triggers a fire alarm or leads to the intervention of the fire brigade or other law enforcement agencies, the Lessor will impose a fine on the Guest to cover the costs of the fire brigade or other law enforcement intervention, as well as the costs of evacuation. The Lessor does not exclude the possibility of additional compensation claims through legal proceedings.
§7. LESSOR’S LIABILITY
  1. The Lessor’s liability for the loss or damage of items brought by the Guest onto the Tranquility Hill premises is governed by the provisions of the Polish Civil Code.
  2. The Guest is obliged to store money, securities, and valuable items, especially valuables and items of scientific or artistic value, in the Lessor’s free deposit.
  3. The Lessor has the right to refuse to accept money, securities, and valuable items, especially valuables and items of scientific or artistic value, for storage if they pose a threat to security or have a value disproportionate to the size or standard of Tranquility Hill, or if they take up too much space.
  4. The Lessor is liable for the loss or damage of money, securities, valuables, or items of scientific or artistic value only if these items have been entrusted to the Lessor for storage in the deposit.
  5. In the event of damage, the Guest should notify the Lessor of the damage immediately after its discovery.
  6. The Lessor is not liable for damage or loss of the Guest’s car or any other vehicle, items left in the vehicle, or live animals, whether the vehicle is parked on the Tranquility Hill premises or outside of it.
§8. RETURN OF LEFT ITEMS 
  1. Items left on the premises of Tranquility Hill belonging to the Guest will be sent to the address provided by the Guest at their own expense.
  2. In case of not receiving instructions from the Guest regarding the return of the left items, the Lessor will store the aforementioned items at the owner’s expense for a period of three months. After this period, the items will become the property of the Lessor.
  3. Claims for compensation for the loss of items brought onto the premises of Tranquility Hill expire one year from the date of the Guest’s cessation of using the Lessor’s services.
  4. The Lessor does not store perishable food items, medicines, or any other items that may be subject to damage or expiration.
§9. NIGHT SILENCE

On the premises of Tranquility Hill, from 11:00 PM until 7:00 AM the following day, a night silence is in effect. During the night silence, all individuals present at Tranquility Hill are obligated to behave appropriately and not disturb the peace of others.

§10. STAY OF ANIMALS
  1. The Lessor does not allow the presence of animals on the premises of Tranquility Hill. The exception applies to animals assisting individuals with visual or mobility impairments or other assisting animals such as police dogs. Animals whose sole function is to provide emotional support and comfort or deterrence from crimes are not considered assisting animals.
  2. In exceptional circumstances, animals may be allowed on the premises of Tranquility Hill upon the Lessor’s approval and for an additional fee. However, the owner of the animal is obligated to keep it in such a way that it does not pose a threat to other Guests and staff.
  3. The Guest is responsible for removing any waste left by the animal on the premises of Tranquility Hill.
§11. SAUNARIUM ZONE
  1. The Saunarium Zone consists of a bathing pond, a children’s pool, the Saunarium building, which includes a dry sauna, a steam bath, an exercise room, changing rooms, and toilets. Additional rules for using the sauna and steam bath are specified in a separate set of regulations available in the Saunarium building.
  2. Prior to using the Saunarium Zone, it is necessary to familiarize oneself with these Regulations. Users of the Saunarium Zone are obligated to comply with the provisions of these Regulations.
  3. The bathing pond (hereinafter referred to as the “Pond”) serves as a place occasionally used for bathing as defined by the provisions of the Water Law Act of July 20, 2017 (Journal of Laws of 2018, item 2268, as amended) and is available for bathing during the hours determined by the Lessor. Outside of these hours, the Lessor is not responsible for individuals bathing in the Pond.
  4. The following color flags are established as indications of bathing possibilities in the Pond:• White flag: bathing allowed, lifeguard on duty. • Red flag: bathing prohibited, lifeguard on duty. • No flag: the Pond is not available for bathing.
  5. The use of the Saunarium Zone is at the Guests’ own risk. Additionally, children under the age of 16 may only be present in the Saunarium Zone under the supervision of parents, legal guardians, or responsible adults.
  6. Leaving children unattended in the Saunarium Zone is prohibited.
  7. Individuals with unstable health conditions (heart conditions, circulatory disorders, balance impairments, or similar conditions) should use the Saunarium Zone with particular caution – after consulting a doctor or at their own risk.
  8. Individuals with disabilities or requiring care due to medical conditions may only be present in the Saunarium Zone under the supervision of a caregiver who is in close proximity.
  9. Children and adults who are not in control of their physiological needs may only be present in the Saunarium Zone while wearing special swim diapers.
  10. Entry to the Saunarium Zone is prohibited for:
  • Persons with visible dermatological conditions, dressings, or bandages on their bodies,
  • Whose behavior may pose a threat to others,
  • Whose hygiene standards deviate from generally accepted norms,
  • Those with infectious diseases,
  • Children under the age of 3 without waterproof diapers,
  • Intoxicated or under the influence of intoxicants.
  • 11. Persons using the Saunarium Zone must wear swimwear. Additionally, please move around the Saunarium Zone wearing safety and hygiene footwear.

    12. Before entering the Pond, it is mandatory to thoroughly shower and disinfect the feet.

    13. Due to the safety of individuals using the Saunarium Zone, mutual observation and assistance as needed are recommended.

    14. Lifeguards are individuals wearing clothing with the emblem “WOPR” or “RATOWNIK.”

    15. Individuals using the Saunarium Zone are required to strictly follow the lifeguards’ instructions.

    16. The following activities are prohibited for individuals in the Saunarium Zone:

    • Entering the water against the lifeguard’s prohibition or when the white flag is not displayed,
    • Damaging equipment and devices in the Saunarium Zone,
    • Disturbing the relaxation of others,
    • Running on the sidewalks near the Pond, in the changing rooms, and under the showers,
    • Pushing and throwing others into the water, jumping into the Pond, submerging other Pond users underwater,
    • Littering and soiling the Saunarium Zone area,
    • Grilling and lighting fires,
    • Bringing dogs and other animals onto the Saunarium Zone premises and bathing animals in the Pond,
    • Using soap, shampoo, and other personal hygiene products in the Pond,
    • Swimming in the Pond with equipment intended for other purposes (e.g., mattresses, etc.),
    • Bringing glass containers, cans, sharp tools, and other dangerous objects onto the Saunarium Zone premises,

    17. Individuals who destroy or damage equipment or devices in the Saunarium Zone are financially and criminally liable for the damage caused.

    18. The Lessor is not responsible for valuable items and personal belongings left in the Saunarium Zone.

    19. Pollution of the Saunarium Zone results in financial penalties as follows: Pond: 2,000 PLN, Children’s pool: 1,000 PLN, Sauna or steam bath: 800 PLN.

    20. Individuals who disturb public order or violate the provisions of the Regulations will be removed from the bathing area.

§12. COMPLAINTS AND ADDITIONAL PROVISIONS
  1. Guests have the right to lodge complaints in case of any shortcomings in the quality of services provided.
  2. All complaints are accepted in person at the Lessors’ office, via email, or by telephone.
  3. Complaints should be submitted immediately upon noticing any shortcomings in the standard of services provided.
  4. Within the premises of Tranquility Hill, it is prohibited to dispose of medical waste (e.g., syringes, needles) in trash cans located in the house or room, under the penalty of bearing all costs incurred due to injury caused by such a needle to another person, including but not limited to reimbursement of medical expenses, hospital stays, medication costs, rehabilitation, specialized care, proper nutrition, and transportation costs to the hospital. Requests for medical waste disposal should be reported to the staff of Tranquility Hill.
  5. Acquisition, street trading, and gambling activities are prohibited within the premises of Tranquility Hill.
  6. Guests are not allowed to make any changes to the houses or rooms, their furnishings, or common areas located within the premises of Tranquility Hill.
  7. In case of violation of the provisions of this regulation, the Lessors may refuse further service to the person who violates them. Such a person is obligated to immediately comply with the demands of the Lessors’ staff, settle the payment for services rendered so far, pay for any damages or destruction caused, and vacate the premises of the Hotel.
  8. Any penalties imposed on the guest, as mentioned in the Regulations, may be satisfied by charging the guest’s credit card by the Lessors.
  9. In justified cases, especially during conferences, important persons’ stays, events, or for safety reasons, the Lessors reserve the right to refuse entry to guests or other individuals present at Tranquility Hill to designated common areas and to demand their departure even if they have previously placed an order.
  10. The guest’s entrance to a closed event organized by the Lessors is equivalent to the guest’s consent to the capturing, storage, processing, and dissemination of their image recorded at the closed event by the organizer, using any technique, for production, reporting, documentation, promotion, and advertising purposes in all fields of exploitation, in particular, the introduction and publishing to a computer and broadcasting in the teleinformatics system (Internet), reproduction and dissemination by printing techniques in the press, playback, broadcasting, and retransmission via a digital or terrestrial television network, and dissemination in such a way that everyone can access it in a place and time of their choice.
  11. From the date of implementation until revocation, but no later than during the period of an epidemic or an epidemic threat in the territory of the Republic of Poland, the Lessors introduce and comply with the guidelines of the Ministry of Development and the Chief Sanitary Inspector available on the website https://www.gov.pl/web/koronawirus and at the Lessors’ office.
  12. The introduction of the guidelines mentioned in paragraph 10 above aims to increase the safety and health protection of guests of Tranquility Hill, as well as to minimize the risk of infection, and does not constitute a basis for the guest to make any claims.
  13. The Lessors reserve the right to make changes to this regulation, with the reservation that reservations made prior to the regulation change shall be subject to the version of the regulations in force at the time the order was placed by the guest.
